NATURAL RESOURCES GOVERNANCE IN NIGERIA; LESSONS FROM SELECTED FEDERATIONS NON-JUSTICIABLE PROVISIONS OF THE NIGERIAN CONSTITUTION
Abstract:
Natural resources governance is a critical aspect of a nation’s development, especially in resource-rich countries like Nigeria. This study investigates the challenges and opportunities in the governance of natural resources in Nigeria, drawing valuable lessons from selected federations and exploring the impact of non-justiciable provisions in the Nigerian Constitution.
Nigeria, as a federal state, is endowed with abundant natural resources, including oil, minerals, and arable land. However, the management of these resources has been plagued by a complex web of issues, including corruption, mismanagement, environmental degradation, and social conflict. To shed light on these challenges, this study employs a comparative analysis, examining the natural resource governance practices in selected federations like the United States, Canada, and Australia.
One of the key aspects explored is the role of non-justiciable provisions in the Nigerian Constitution. Nigeria’s Constitution contains numerous provisions related to natural resources management, but many of these are non-justiciable, making them difficult to enforce through legal channels. This study assesses the implications of these non-justiciable provisions on resource governance and the rule of law in Nigeria.
The research findings reveal that Nigeria can draw valuable lessons from other federations with more successful natural resources governance models, such as revenue allocation mechanisms, environmental protection measures, and indigenous rights recognition. The study also highlights the need for reforming non-justiciable provisions to make them more effective in holding governments accountable for responsible resource management.
In conclusion, this research contributes to the discourse on natural resources governance in Nigeria by offering insights into the challenges and opportunities in the sector and by examining the impact of non-justiciable provisions in the Nigerian Constitution. The lessons drawn from selected federations can provide policymakers and stakeholders in Nigeria with valuable guidance for improving the management of their abundant natural resources.
