Abstract:
The three arms of government, namely the executive, legislative, and judicial arms, play critical roles in the governance and administration of any democratic nation. However, conflicts between these arms can arise due to divergent interests, power struggles, and constitutional interpretations. This abstract aims to explore the nature of conflicts that arise from the three arms of government in Nigeria and the mechanisms employed for their resolution.

The executive arm, led by the President, holds the power of decision-making and policy implementation. Conflicts can emerge when the executive’s actions are perceived as infringing upon the authority of the legislative or judicial arms, or when the President’s decisions are met with opposition. Such conflicts can manifest as disagreements over budgetary allocations, legislative oversight, or judicial review of executive actions.

The legislative arm, comprising the National Assembly, is responsible for making laws, representing the interests of the people, and providing checks and balances on the executive arm. Conflicts can arise when the legislature perceives executive actions as unconstitutional or when the executive influences legislative processes. Additionally, conflicts may occur within the legislature itself, such as disagreements between the Senate and the House of Representatives.

The judicial arm, headed by the Supreme Court, interprets laws and resolves legal disputes. Conflicts between the judiciary and the other arms can emerge when court decisions are seen as encroaching upon executive or legislative prerogatives. The executive and legislative arms may also criticize judicial decisions they perceive as biased or inconsistent with the Constitution.

To address conflicts arising from the three arms of government in Nigeria, various mechanisms are employed. These include judicial review, where the judiciary assesses the constitutionality of executive or legislative actions; legislative oversight, enabling the legislature to scrutinize executive activities; and inter-branch dialogue, fostering communication and negotiation between the arms. Additionally, constitutional provisions, such as separation of powers and the rule of law, serve as guiding principles for resolving conflicts.

This abstract provides an overview of the conflicts that can arise from the three arms of government in Nigeria and highlights the mechanisms used for conflict resolution. Understanding these conflicts and the approaches to address them is crucial for promoting good governance, upholding the rule of law, and maintaining a harmonious balance among the arms of government in Nigeria’s democratic system.
